Terms of sale

ARTICLE 1 – INTRODUCTION

The site lelamier.com is operated by LAMIER (“the Seller”).
By accessing the Site and/or making a purchase, the user (“the Customer”) accepts these Terms and Conditions of Sale and Use (the “Terms”).

These Terms apply to every user of the Site, including visitors, customers and contributors of content.


ARTICLE 2 – CONDITIONS OF USE

By accepting these Terms, the Customer confirms that they are of legal age and legally able to enter into a contract.

Any fraudulent or illegal use, or any use contrary to French law, is grounds for immediate termination of access rights to the Service.


ARTICLE 3 – PRODUCT INFORMATION

The products sold by LAMIER (safety razors, blades, accessories) are described and presented as accurately as possible.

Images, colours and graphics may differ slightly from the actual product depending on the screen used.

Products containing sharp parts are intended for an adult audience and must be handled with care.


ARTICLE 4 – PRICES AND CHANGES

Prices shown are in euros, including all taxes.

LAMIER reserves the right to change its prices or to suspend the Service at any time and without notice, without incurring liability.


ARTICLE 5 – ORDERS AND ACCURACY OF INFORMATION

LAMIER reserves the right to refuse or cancel any order:

  • where information is incorrect or incomplete,
  • where fraud is suspected,
  • in the case of repeated orders or abusive use.

The Customer undertakes to provide accurate, complete and up-to-date information when ordering.


ARTICLE 6 – PAYMENT METHODS

Payments are made through the secure providers offered on the Site (Stripe, PayPal, Shopify Payments and others).

LAMIER has no access to the customer's banking details.


ARTICLE 7 – DELIVERY

Delivery times are given as an indication.

LAMIER cannot be held liable for:

  • delays caused by the carriers,
  • losses caused by an incorrect address,
  • events of force majeure.

ARTICLE 8 – RETURNS POLICY

Given the nature of the products sold (razors, blades, accessories that come into contact with the skin), returns are strictly controlled in order to protect hygiene, safety and the wellbeing of customers.

8.1 – No returns for opened products

For hygiene and safety reasons:

The condition of any returned product is examined on arrival.

Whether a product counts as damaged is assessed against its original condition, its normal function and the standards for the product, on the basis of objective evidence (marks of wear, impacts, scratches, breakage, alteration of components and so on).

This rule applies within the right of withdrawal (Directive 2011/83/EU), which provides an exception for sealed products that cannot be returned for hygiene reasons.

8.2 – Returns accepted only for unopened products

The Customer may exercise their right of withdrawal within 14 days, only if:

  • the product is new,
  • unopened,
  • in its original sealed packaging,
  • with no sign of use.

8.3 – Faulty product or picking error

If a product is faulty or the wrong item has been sent:

  • the Customer must contact LAMIER within 48 hours with photo or video evidence,
  • state the order number and the batch number,
  • the Seller may offer an exchange, a repair or a refund.

No return is accepted where the product has been used improperly.


ARTICLE 9 – MANDATORY INSTRUCTIONS FOR USE

Every safety razor is supplied with detailed instructions for use, in accordance with European regulations.

The Customer expressly acknowledges:

  • having read the instructions,
  • understanding the risks inherent in using sharp blades,
  • being able to handle a safety razor safely.

ARTICLE 10 – SAFETY, USE AND RISKS

10.1 – Adults only

The razors and blades sold by LAMIER:

  • are sharp implements,
  • must be handled with care,
  • must be kept out of reach of children and of anyone unfamiliar with them.

10.2 – Proper use

The Customer undertakes to:

  • read the instructions carefully,
  • not use the razor on broken or irritated skin,
  • change the blades regularly,
  • not use parts that are not supplied or not compatible.

10.3 – Warnings

Shaving with a safety razor carries inherent risks:

  • cuts,
  • micro-cuts,
  • irritation,
  • skin reactions.

The customer accepts these normal risks associated with the product.


ARTICLE 11 – LIABILITY

LAMIER guarantees products that comply with European regulations, in particular:

  • Directive 2001/95/EC (General Product Safety)
  • REACH
  • The standards applicable to sharp implements

LAMIER cannot be held liable for:

  • improper use of the product,
  • a lack of care,
  • damage resulting from use for a purpose other than intended,
  • injuries caused by a sudden or clumsy movement,
  • skin reactions linked to the Customer's skin type,
  • indirect damage (loss of time, non-material loss and so on).

In any event, the Seller's liability is limited to the amount of the order.


ARTICLE 12 – STATUTORY GUARANTEES

The Customer benefits from the statutory guarantees:

Statutory guarantee of conformity (articles L217-3 to L217-20 of the French Consumer Code)

Duration: 2 years.

Guarantee against hidden defects (articles 1641 to 1649 of the French Civil Code)

LAMIER covers proven manufacturing defects only.


ARTICLE 13 – CUSTOMER REVIEWS (compliance with the 2022 DGCCRF rules)

LAMIER states that:

  • published reviews may or may not be verified;
  • reviews are never paid for;
  • reviews may be moderated;
  • fake reviews are prohibited and removed.

ARTICLE 14 – PERSONAL DATA

Data is handled in accordance with the Site's Privacy Policy.


ARTICLE 15 – PROHIBITED USES

The following are prohibited:

  • any fraudulent activity,
  • distributing viruses or malicious software,
  • circumventing security systems,
  • unauthorised collection of data.

ARTICLE 16 – MEDIATION

In accordance with the French Consumer Code, the Customer may use a mediator free of charge after first contacting customer service.

ARTICLE 17 – APPLICABLE LAW AND JURISDICTION

These Terms are governed by French law.
Any dispute will be brought before the competent French courts.

ARTICLE 18 – SMS MARKETING AND CART REMINDERS

We take your privacy seriously. The information collected through our SMS marketing programme is used solely to send you notifications about your orders and promotional offers.

Collection and consent: your consent to SMS marketing is collected explicitly (opt-in). It is separate from any other marketing consent (email) and is not required in order to make a purchase on our site.

Cart tracking (abandoned carts): our shop uses cookies to track the items you place in your cart, including when you have left your order unfinished. If you have consented to receive our marketing SMS, this information may be used to send you cart reminders by SMS.

Unsubscribing: you have a permanent right to object. To stop receiving our SMS, you can:

  1. reply STOP to any SMS you receive;
  2. click the unsubscribe link included in our messages.

Charges and operators: this service is free on our side, but standard message or data charges may be applied by your mobile operator depending on your plan.
